Rental Terms & Conditions

Borrow A Bin – Rental Agreement & Terms of Service

 

By placing an order or using Borrow A Bin LLC services you (“Customer,” “you”) agree to these terms.

1) Definitions

Equipment: Plastic moving bins (sizes M/L/XL), plastic wardrobe boxes, dollies, dish/glass inserts, lids, and any accessories delivered with them.

Rental Period: Starts once the equipment is delivered to the customer and ends at successful pickup.

Flight of stairs: A continuous set of steps (3–8 steps). Elevator service does not count as stairs

2) Ordering; Acceptance of Terms

Placing an order or using our services constitutes acceptance of these terms. If you do not agree, do not use the services.

3) Rental Period; Extensions; Early Pickup

Standard rental duration rates are shown at checkout.  1 Week is defined as 7 days.

Extensions: If Equipment is retained beyond the Rental Period, the rental renews weekly at the published weekly rate for your bundle.

Early pickup: Pro-rated refund will be provided for early pickups.

4) Delivery, Access & Pickup

You must provide accurate address, contact info, building access (gates, elevators, concierge), and reasonable loading/parking.

Waiting time: If you are >15 minutes late, we may (a) reschedule and charge a Redelivery/Reschedule Fee or (b) continue waiting and charge Waiting Time per the Fee Schedule.

Logistically infeasible means we cannot complete service due to hazards, blocked access, unsafe/illegal parking, or other conditions beyond our control; Redelivery/Reschedule Fee applies.

Safe Drop Authorization (optional): If you ask us to leave Equipment unattended, risk of loss transfers upon drop at the agreed location. You are responsible for theft, weather, vandalism, or third-party damage.

5) Care, Custody & Use of Equipment

You are responsible for Equipment from delivery until pickup, including secure, weather-protected storage and ordinary care. Do not use outdoors unprotected, for liquids, or for hazardous/contaminated materials. Do not alter, drill, or label with non-removable adhesives.

6) Cleaning & Labels

Cleaning: A Cleaning Fee per bin applies for returns that are exceptionally dirty or wet (beyond ordinary household dust/debris).

Labels: We supply easy-peel labels; you may leave them on at return. A Label Removal Fee per bin applies only if non-removable/industrial adhesives are used.

7) Loss, Damage & Replacement

You are responsible for loss, theft, or damage while in your custody, including damage to third-party property arising from your misuse or failure to secure Equipment. Replacement Costs are listed in the Fee Schedule and apply to missing items or irreparable damage (including missing lids/straps/wheels where applicable). Cosmetic scuffs from ordinary use are not damage.

8) Rescheduling & Cancellations

≥24 hours before delivery: full refund less any card processing fees.

<24 hours before delivery: Restocking Fee applies.

Weather/road closures or other Force Majeure may require rescheduling without fee.

9) Payment; Card on File; Authorizations

You authorize us to keep your card on file through final pickup.

You authorize: (i) an initial authorization equal to the order total, and (ii) charges for extensions, missed/late appointments, waiting time, redelivery, cleaning, damage, unreported stairs, and Replacement Costs per the Fee Schedule.

If Equipment isn’t returned within 7 days after the Rental Period and we cannot reach you, we may place an authorization up to the replacement value of unreturned items and charge when deemed lost.

You agree to pay reasonable collections costs and chargeback fees we incur if a bank reverses a valid charge.

10) Indemnification (Third-Party Claims)

You agree to indemnify and defend Borrow A Bin (and its owners/employees/agents) from third-party claims and losses arising from your misuse of Equipment or failure to provide safe access/storage. This section does not require you to indemnify us for our gross negligence or willful misconduct.

11) Limitation of Liability

To the maximum extent permitted by law, our total liability arising out of the services or Equipment shall not exceed the rental fees you paid for the affected order. We are not liable for indirect, incidental, special, punitive, or consequential damages.

12) Text Messaging (SMS/MMS)

By providing your phone number, you agree to receive transactional texts about your order, delivery, pickup, and billing. Message frequency varies; msg & data rates may apply. Reply STOP to opt out; HELP for help; support: support@borrowabin.com. Consent is not a condition of purchase. Marketing texts, if any, require separate opt-in. See our Privacy Policy for details.

13) Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., severe weather, accidents, road closures, strikes, power outages).

14) Photos & Verification

We may photograph Equipment counts/condition at delivery and pickup to document fulfillment and resolve disputes.

15) Governing Law; Venue; Small Claims

These terms are governed by Virginia law. Exclusive venue is the state courts in Fairfax County, Virginia, except either party may bring an eligible claim in small-claims court.

16) Severability; No Waiver; Entire Agreement

If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. These terms are the entire agreement for your order and supersede prior communications.

17) Electronic Signatures & Notices

You consent to do business electronically and agree that clicks, checkboxes, and typed names constitute your signature for this Agreement. Notices may be sent to the email/phone you provided.
